Drinking or consuming raw milk is legal in all 50 states. With the exception of Michigan, no state specifically prohibits the sale of raw milk for animal feed. As of April 2016, the sale of raw milk in stores in 13 states is legal. 17 states allow the sale of raw milk only on farms; 8 of the states that prohibit the sale allow the purchase of raw milk only through cow-sharing agreements; and 20 other states prohibit the sale of raw milk. The FDA should have no rational or reasonable basis to argue against raw butter and its legal access for all Americans. The courts should take the side of the facts and order the FDA to regulate raw butter in the same way they regulate 60-day raw cheese so that it can circulate freely throughout America. Did you know that it is currently illegal to sell raw milk across state borders? The FDA`s ban on interstate raw milk hurts both small farms and informed consumers who intentionally seek raw milk for its health benefits and great taste. The map above shows the most permissive category for raw milk production in each state. Please see the table below for a more detailed overview of how raw milk can be legally obtained in your state. This petition concerned the legalization of the shipping and sale of raw butter across national borders. Instead of dismantling the entire raw milk wall, we decided to focus on the weakest stone in the wall: RAW BUTTER! The rest of the bricks would fall later after RAWMI did his job to make raw milk very low-risk and safe. Unfortunately, because Montana legalized raw milk but did not provide standards or training for low-risk raw milk production, the Campylobacter outbreak in the fall of 2021 was a predictable scenario. History has shown that repeated outbreaks related to raw milk lead government agencies to ban raw milk altogether or create difficult restrictions. To ensure both consumer safety and continued legalization of raw milk, it was imperative that Montana farmers have access to the training and resources needed to produce low-risk raw milk. In collaboration with the Farm to Consumer Legal Defense Fund, RAWMI is suing the Food and Drug Administration (FDA) for legalizing raw butter! Currently, it is illegal to ship or sell raw butter across state borders. The FDA denies Americans access to raw butter, which is a very powerful anti-inflammatory food, while we suffer from more chronic diseases! The FDA was asked to change raw butter laws in 2016.
You`re supposed to respond to citizens` petitions within 180 days, but the raw butter petition hasn`t received a response from the FDA in over 3 years.
