The Concept of Law and Justice in Islamic Jurisprudence

In order to perfect the concept of justice, Allah commands us to stand firm for what is true, even in situations where our hearts are inclined to what is unjust. No matter who is to blame, we MUST stand up for what is right. Even if we ourselves are the culprits, we have no right to escape punishment. We cannot hide our family`s misconduct. Allah knows our natural inclinations and has therefore firmly commanded us not to follow the desires of our hearts for fear of escaping justice. We live in a world where there are people who commit crimes and cause chaos in society. There are people who commit theft. There are people who destroy cities. There are people who torment others. There are people who are not fair and just when it comes to their relationships with people. Often, they get away with their misdeeds.

When so much injustice exists, it can sometimes be difficult to see the good in society. We ask ourselves: “There were only prophets and messengers sent by Allah in the past. Are there no righteous people today? By the mercy of Allah (swt), there are always people in this world who have the Taqwa of Allah (swt) and will judge among people with righteousness. “O you who believe! Stand firm for Allah as righteous witnesses, and do not let enmity and hatred of others lead you to avoid justice. Be fair, it is closer to godliness, and fear Allah. Truly, Allah knows well what you are doing. (Al-Ma`idah: 8) “Verily, Allah does not harm people, but people are unjust to themselves. (Surah Yunus: 44) And he lifted up the heavens, and he created the balance (of righteousness). So that you cannot exceed the balance (due). So put weight with justice and don`t lose in limbo. (Surah Ar-Rahman: 7 – 9) Here Allah (swt) tells us that He will establish a balance of righteousness on the Day of Resurrection. On this day, no one is treated unfairly.

If there is something as small as the weight of a mustard seed, Allah (swt) will take it into account in His manifest wisdom. Allah will be our judge. “Verily, Allah commands that you return the administrators to those to whom they are due; And when you judge between people, you judge justly. Truly, how excellent is the teaching He (Allah) gives you! Truly, Allah is always a hearer, an all-seer. (Surah Nisa: 58) 1. Allah (swt) has created the balance of justice in this world. This is His divine law. Injustice is widespread on this earth. There can be no peace without the firm establishment of justice. The more you see the injustice, the more you realize how important it is to establish justice in the country.

If humanity lacks guidance on how to live its life, the entire structure of society will be damaged. Allah (swt) has sent the Qur`an as a guide for all mankind, with all the rules and regulations we need to stay on the right path. Islam is a very complete way of life. All rules that are good for humanity have been decreed in Allah`s Sharia (swt). Everything we need to live successfully is in the Qur`an. Among these very important laws taught by God is the law of establishing justice. “And we will create a balance of justice on the Day of Resurrection, then no one will be treated unjustly in any way. And if there is the weight of a mustard seed, we will bring it. And we are sufficient to take that into account. (Al-Anbiya: 47) Establishing justice is the law of Allah (swt). This is part of the balance that Allah has created. In Surah Ar-Rahman, Allah (swt) describes how He created a balance of justice and why: In this study, we will examine Insha`Allah, explore the different ayaats of the Qur`an regarding justice and how we can apply them in our daily lives.

Before we begin, let`s look at the definition of justice. What is justice and what do we mean by this term? Among the great names and attributes of Allah (swt) is Al-Hakam, which means “The Judge”. Allah (swt) is the most just, and He judges the affairs of His beings with full justice. There are several ayaats in the Qur`an that describe the righteousness of Allah (swt). Among them are the following: “Allah commands justice, to do good and generosity for children and parents, and He forbids all shameful acts, injustice and rebellion: He commands you to receive admonition.” (Surah An-Nahl: 90) “Verily, Allah does not harm the weight of an atom, and if it is a good deed, He multiplies it and gives of Himself a great reward.” (Surah Nisa: 40) These ayaat tell us that humanity is lost. Only those who have true faith in Allah, perform righteous deeds and unite in mutual teaching of truth and patience have saved themselves from this loss.
